HABIT BURGER & GRILL DODGERS SWEEPSTAKES (“SWEEPSTAKES”)
OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN OR CLAIM PRIZE.
A PURCHASE OR PAYMENT WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING.
NOTICE REGARDING DISPUTE RESOLUTION: These Official Rules contain terms that govern how claims between you and The Habit Restaurants, LLC, relating to your participation in the Sweepstakes will be resolved. For example, Section 13 includes an arbitration agreement and waiver of a class action that requires you to submit all claims to arbitration (instead of going to court before a judge and jury) and limits your ability to bring claims only in an individual capacity (and not as part of or on behalf of any class action or purported collective or representative claim or proceeding). Please read these provisions carefully as they affect your legal rights. You acknowledge that you have read and agree to be bound by these Official Rules.

On or about September 15, 2026, Sponsor will randomly select two (2) potential Grand Prize winners and eight (8) potential First Prize winners, from among all eligible entries received during the Sweepstakes Period. - TAMPERING AND DELIVERY DISCLAIMER. Released Parties are not responsible for typos or misprints in these Official Rules, in any Sweepstakes-related advertisement or other materials, technical or human error which may occur in the administration of the Sweepstakes, or the processing of Entries.
The Sponsor further reserves the right to: (i) cancel, terminate, suspend, declare null or void, amend, alter, or modify the Sweepstakes, void any suspicious entries, rescind any Prize, and/or determine an absolute resolution and/or an alternate method of conducting the Sweepstakes and/or awarding a Prize at any time, for any reason, or if, in the sole discretion of the Sponsor, it is impossible or impractical to complete or conduct the Sweepstakes as planned for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures of any sort, programming associated with or used in the Sweepstakes, human error that may occur in the execution of the Sweepstakes, or any other causes which affect the operation of the Sweepstakes or these Official Rules, or that violates or compromises the integrity of the Sweepstakes, whether intentionally or unintentionally, by any person, whether or not an entrant in the Sweepstakes, and/or (ii) stop or conclude the Sweepstakes at any time without prior notice. Material changes to the Official Rules will be published where practical. In the event of termination of the Sweepstakes by Sponsor, Sponsor reserves the right to award any Prize in a manner deemed fair and equitable by Sponsor.
- PUBLICITY. Except where prohibited, by accepting a Prize, the Prize winner grants the Sponsor permission to use their name, character, image, voice, and likeness worldwide, in perpetuity, in any and all media now known or hereinafter invented in any and all marketing and promotional materials and waive any claims to royalty, right, or remuneration for such use at Sponsor’s sole discretion. The Prize winner’s name may be included in a publicly available winner’s list.
- USE OF PERSONAL INFORMATION. The Sponsor will retain each Eligible Entrant’s personal data for a reasonable period of time to enable it to send that Eligible Entrant the Prize, verify that these Official Rules have been complied with, and/or for accounting purposes. This data may be passed to a third party to enable such third party to fulfill any necessary requirements relating to the award of a Prize. Any other use of personal data will be in accordance with, and subject to, the Sponsor’s Privacy Policy found on the Entry Page.
- RELEASES, CONDITIONS, AND LIMITATIONS OF LIABILITY. By participating in the Sweepstakes, each entrant agrees to release and waive any and all claims of liability against the Sweepstakes Entities and any applicable third party fulfillment service, and each of their respective employees and agents (collectively, the “Released Parties”) from and against any and all liability, loss or damage (including personal injury or death) incurred with respect to the conduct of or participation in the Sweepstakes, or the awarding, shipping/handling, receipt, possession, and/or use or misuse of any Prize, including any travel related thereto. By accepting a Prize, each winner hereby agrees: (i) to release each of the Released Parties from any and all claims in connection with the Sweepstakes and the award or use of a Prize; and (ii) where allowed by law, to sign a publicity release confirming consent to use the winner’s name/likeness prior to acceptance of a Prize. The Released Parties are not responsible or liable to any Eligible Entrant, winner, or any person claiming on behalf of such Eligible Entrant or winner, for failure to supply a Prize or any part thereof, by reason of any acts of God, any action, regulation, order or request by any governmental or quasi-governmental entity (whether or not the action, regulations, order or request proves to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, volcanic eruption, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond the Released Parties’ sole control. Upon awarding a Prize, the Sponsor will have no further obligation to the applicable winner.
- TAXES. Any valuation of the Prizes stated above is based on available information provided to the Sponsor, and the value of any actual Prize awarded to a Prize winner may be reported to the IRS as required by law via a Form 1099. A Form 1099 will be issued to all applicable tax authorities for any individual winning a Prize from Sponsor totaling $2,000 or more in value cumulatively, in a single calendar year. Winners are solely responsible for reporting the value of the Prizes received as income, regardless of the amount or whether a Form 1099 is issued.
- CONDUCT AND DECISIONS. All decisions of the Sponsor will be final and binding on all matters relating to the Sweepstakes. Persons who violate any rule, gain unfair advantage in participating in the Sweepstakes, or obtain winner status using fraudulent means will be disqualified. The Sponsor will interpret these Official Rules and resolve any disputes, conflicting claims, or ambiguities concerning these Official Rules or the Sweepstakes, and the Sponsor’s decisions concerning such disputes shall be final.
- BINDING ARBITRATION. By participating in the Sweepstakes, each Eligible Entrant and Sponsor agree that disputes that cannot be resolved informally shall be resolved through binding individual arbitration, with limited exceptions, as fully described in Section 3 of Sponsor’s Terms of Use, which are expressly incorporated by reference. As described in those terms, each Eligible Entrant and Sponsor agree that the arbitrator may award the same relief available in court, provided that such relief (including declaratory or injunctive relief) shall only be in favor of the individual party seeking relief and only to the extent necessary to provide the relief warranted by that party’s individual claim. EACH ELIGIBLE ENTRANT AND SPONSOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THEIR INDIVIDUAL CAPACITIES AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, COLLECTIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING, WHETHER IN ARBITRATION OR IN LITIGATION. FURTHER, UNLESS THE PARTIES AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE ANY PERSON’S OR ENTITY’S CLAIMS WITH THOSE OF ANOTHER PERSON OR ENTITY AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS, REPRESENTATIVE, COLLECTIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING. IF, AFTER EXHAUSTION OF ALL APPEALS, ANY OF THESE PROHIBITIONS ON NON-INDIVIDUALIZED RELIEF, CLASS, REPRESENTATIVE, COLLECTIVE, AND PRIVATE ATTORNEY GENERAL CLAIMS, AND CONSOLIDATION, ARE FOUND TO BE UNENFORCEABLE AS TO A PARTICULAR CLAIM OR WITH RESPECT TO A PARTICULAR REQUEST FOR RELIEF (SUCH AS A REQUEST FOR INJUNCTIVE RELIEF), THEN THE PARTIES AGREE THAT SUCH A CLAIM OR REQUEST FOR RELIEF SHALL BE DECIDED BY A COURT AFTER ALL OTHER CLAIMS AND REQUESTS FOR RELIEF ARE ARBITRATED. Notwithstanding the foregoing, either party retains the right to have a dispute heard in small claims court, provided the dispute falls within the jurisdictional limits of that court, otherwise qualifies for that court, seeks individualized relief, and remains in that court and is not removed or appealed to a court of general jurisdiction.
- Sponsor reserves the right to determine eligibility should special circumstances arise. Sponsor’s decisions are final and binding. Sponsor disclaims any responsibility to notify Eligible Entrants of any aspect related to the conduct of the Sweepstakes. As a condition of participating in the Sweepstakes, Eligible Entrants agree (and agree to confirm in writing) that: (a) under no circumstances will Eligible Entrants be permitted to obtain costs, judgments, or awards for, and Eligible Entrants hereby knowingly and expressly waive all rights to claim or seek, punitive, incidental, consequential, special, or any other damages, other than for actual, third-party out-of-pocket expenses, and in such limitation, Eligible Entrants further waive any rights to have damages multiplied or otherwise increased; (b) any and all disputes, claims, or causes of action arising out of or connected with the Sweepstakes, or any Prize awarded, shall be resolved individually, through binding arbitration as set forth above, without resort to any form of class action; and (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred (if any), excluding attorneys’ fees and court costs. Some jurisdictions do not allow the limitations or exclusion of liability, so the above may not apply to every Eligible Entrant. Participation in the Sweepstakes constitutes each Eligible Entrant’s full and unconditional agreement to, and acceptance of these Official Rules. Winning a Prize is contingent upon an Eligible Entrant’s fulfillment of all requirements set forth herein.
- COMPLIANCE WITH LAW AND GOVERNING LAW. All issues and questions concerning the construction, validity, interpretation and enforceability of the Sweepstakes’ Official Rules, or the rights and obligations of an Eligible Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 13 (Binding Arbitration) of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of California, in the County of Orange.
